PLURALISME HUKUM DI INDONESIA
Keywords:
Pluralism, law, legal systemAbstract
Legal pluralism can generally be explained as a condition in which there are two or more legal systems that apply in a country. And legal plurasilems coexist in the social dimension of society. This has implications for the understanding and application of law in different communities. In the context of Indonesia, legal pluralism cannot be ignored, because it is a reality that exists in the life and legal system of our country. The birth of the conception of legal pluralism does not mean wanting to form a new legal system. However, the conception is a paradigm of thinking that emphasizes the importance of recognizing the diversity of laws that exist and are still alive in the midst of social life. And until now, there are at least three legal systems whose existence is still recognized by the state, the three legal systems are: Customary law, Islamic law and positive law.
