Abstract

Indonesian culture has a belief that the presence of adopted children for families who do not have children is very good to be a "lure" so that families who do not have children can immediately have children. And Indonesian law itself allows for families who want to carry out child transportation on the grounds that there are quite a lot of neglected children in Indonesia. This research method uses a literature study. The conclusion of this research is: the position of adopted children is not the same as the position of biological children. The differences between biological children and adopted children are quite clearly mentioned in the Qur'an, among others: Adopted children do not have the position as the owner of the heir rights of their adoptive parents, and vice versa. Adopted children may only use the name of their adoptive parents as identification but not as a nasab name. And adoptive parents, at any time, do not have the right to become guardians if their adopted children want to get married. The Qur'an also confirms that adopted children do not have blood relations with their adoptive parents and do not have inheritance rights.
